AGREEMENT TO OUR TERMS These Terms of Use ("Terms") are a legal agreement between you and Proven Form, LLC ("Proven Form," "we," "us," or "our"), a Pennsylvania limited liability company, for your use of Levelday, the Levelday mobile app, levelday.app, and related services that link to these Terms (collectively, the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. You can contact us at [email protected] or through https://levelday.app/support.

Levelday is intended for users who are at least 13 years old, or the minimum age required by law in their jurisdiction. If you are under the age of majority where you live, you may use Levelday only with permission and supervision from a parent or legal guardian.

1. THE SERVICE Levelday is a mobile app that lets users manually track daily wellness and nutrition-related values such as calories, protein, water, fiber, sugar, caffeine, and custom metrics. Some paid features may offer provider-backed nutrition lookup to help you create entries you review and confirm. The Service is designed for personal daily awareness and self-tracking.

We may add, remove, change, suspend, or discontinue features at any time, including for product, technical, legal, platform, or security reasons.

2. WELLNESS USE ONLY; NO MEDICAL ADVICE Levelday is a general wellness and self-tracking tool. The Service is designed to help you manually track values you choose, such as calories, protein, water, fiber, sugar, caffeine, and other custom metrics.

Levelday does not provide medical, dietary, nutritional, fitness, or health advice. The Service does not diagnose, treat, cure, prevent, monitor, or manage any disease, condition, symptom, or medical state. Information shown in the Service is for general awareness only and should not be relied on as a substitute for advice from a physician, registered dietitian, nutritionist, or other qualified professional.

You are responsible for deciding what to track, setting your own goals, and determining whether those goals are appropriate for you. Consult a qualified professional before making health, diet, hydration, fitness, or medical decisions based on information from the Service.

Levelday is not intended for emergencies, clinical monitoring, eating disorder treatment, medical nutrition therapy, hydration therapy, medication management, or any other regulated or professional health use. Do not use the Service as your only source of information for health, nutrition, hydration, or medical decisions.

3. USER ENTRIES AND ACCURACY Levelday relies on information that you enter, configure, or choose to track. We do not independently verify the accuracy, completeness, suitability, or safety of your entries, goals, shortcuts, calculations, or tracked values.

Progress indicators, summaries, widgets, trends, and other displays are based on your entries and app settings. They may be incomplete, delayed, inaccurate, or unavailable. You are responsible for reviewing your entries and correcting mistakes.

Provider-backed nutrition lookup results, including food names, serving options, and nutrient values, come from third-party sources and may be incomplete, estimated, mislabeled, stale, or unavailable. You are responsible for reviewing lookup results before logging them. Required provider attribution may appear wherever provider-backed nutrition information is displayed.

Camera-based food photo analysis transmits the photo to Levelday servers and then to Edamam only to process the nutrition analysis; Levelday does not store food photo images in hosted storage.

4. ACCOUNTS You may need an account to use some or all of the Service. You agree to provide accurate account information, keep your login credentials secure, and notify us if you believe your account has been compromised.

You are responsible for activity under your account. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk, used the Service unlawfully, or misused the Service.

5. STORAGE OF USER DATA Levelday stores certain information you provide, including tracking entries, goals, app settings, enabled metrics, shortcut configurations, account information, purchase entitlement records, and related usage records, in our systems or with service providers that help us operate the Service.

This storage is used to provide app functionality, including saving your progress, displaying history, restoring your data, syncing across devices where available, supporting widgets, processing purchases, maintaining security, troubleshooting issues, and improving reliability.

Our use of your information is further described in the Privacy Policy.

6. NO SALE OR ADVERTISING USE OF WELLNESS DATA We do not sell your user-entered wellness or nutrition data. We also do not use your user-entered tracking entries for targeted advertising, third-party marketing, data brokerage, or unrelated profiling.

We may share information with service providers that process data on our behalf to operate, maintain, secure, or support the Service, as described in the Privacy Policy.

7. PRO FEATURES AND LIFETIME PURCHASE Levelday may offer paid features, including a one-time lifetime purchase. A lifetime purchase means access to the paid Levelday features made available under that purchase for as long as we continue to offer and support the Levelday app, subject to these Terms.

A lifetime purchase does not guarantee that every future feature, third-party service, platform, integration, or separately branded product will be included. We may add, remove, modify, or limit features where necessary for product, technical, legal, platform, or security reasons.

Purchases may be processed by Apple, Google, RevenueCat, or another payment or entitlement provider. Refunds, cancellations, renewals, and purchase management may be governed by the applicable app store or payment provider rules.

8. WIDGETS, NOTIFICATIONS, AND DEVICE DISPLAY If you enable widgets, lock screen widgets, home screen widgets, notifications, reminders, or similar features, Levelday may display selected tracking information outside the main app interface. Anyone who can view your device may be able to see that information.

You are responsible for choosing whether to enable these features and for configuring what information appears on your device.

9. ACCEPTABLE USE You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

interfere with, disrupt, overload, or compromise the Service or connected systems;

access the Service through unauthorized automated means;

copy, modify, reverse engineer, decompile, or attempt to derive source code from the Service except where law allows;

use the Service to violate the rights of others or applicable law;

submit malicious code, false reports, abusive content, or unlawful material;

use the Service to develop, train, improve, or benchmark a competing product without our written permission;

sell, transfer, sublicense, or misuse your account or access rights.

10. INTELLECTUAL PROPERTY We own or license the Service, including software, designs, text, graphics, logos, trademarks, and related materials. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

You retain ownership of your entries and other content you submit. You grant us permission to host, store, process, transmit, display, and otherwise use that content only as needed to operate, maintain, secure, support, and improve the Service, comply with law, enforce these Terms, and as described in the Privacy Policy.

If you send feedback or suggestions, you allow us to use them without restriction or compensation.

11. PRIVACY Please review our Privacy Policy at https://levelday.app/privacy-policy. The Privacy Policy explains how we collect, use, store, share, retain, and delete information.

12. THIRD-PARTY SERVICES AND APP STORES The Service may rely on third-party services, including hosting, authentication, analytics, diagnostics, payment, entitlement, app store, nutrition lookup, and support providers. Your use of those services may be subject to their own terms and policies.

If you download Levelday through the Apple App Store, Google Play, or another app distributor, your use of the app may also be subject to that distributor's terms and rules. App distributors are not responsible for providing maintenance or support for the Service unless required by law.

13. CHANGES, AVAILABILITY, AND TERMINATION We may update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date and will be effective when posted or otherwise communicated, unless a later effective date is stated. Your continued use of the Service after an update becomes effective means you accept the updated Terms.

We cannot guarantee that the Service will always be available, uninterrupted, secure, or error-free. We may suspend or terminate your access if we reasonably believe you violated these Terms, created risk, used the Service unlawfully, or if we discontinue the Service or a feature.

14. DISCLAIMERS THE SERVICE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service, entries, goals, summaries, widgets, calculations, notifications, or displays will be accurate, complete, secure, timely, uninterrupted, or suitable for your needs. You use the Service at your own risk.

15. LIMITATIONS OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW, PROVEN FORM, LLC AND ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR LOSS OF GOODWILL.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE OR THESE TERMS WILL BE LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID TO US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some laws do not allow certain disclaimers or limitations, so some of the above may not apply to you.

16. INDEMNIFICATION You agree to defend, indemnify, and hold harmless Proven Form, LLC and its owners, directors, officers, employees, contractors, agents, affiliates, and service providers from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service, your entries or content, your violation of these Terms, your violation of law, or your violation of another person's rights.

17. MISCELLANEOUS These Terms and the Privacy Policy make up the entire agreement between you and us regarding the Service. If any part of these Terms is found unenforceable, the remaining parts remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later.

We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction. You may not assign these Terms without our written permission. These Terms are governed by the laws of Pennsylvania and the United States, without regard to conflict-of-law rules, unless non-waivable consumer protection law requires otherwise.
